APPLICATION FOR VARIANCE, Planning Commission (Revised December 2006)

A variance is any modification, or relief from, a Township land use ordinance where it is determined by the Planning Commission that, by reason of exceptional circumstances, the strict enforcement of the provisions of such ordinance would cause unnecessary hardship as defined in the Township Zoning regulations. Variances require official public notification and Planning Commission action. (Zoning Ordinances are available in Duluth Town Hall).  A building permit is also needed if the variance is granted. 

APPLICATION FOR CONDITIONAL USE PERMIT, Planning Commission (Revised December 2006)

A conditional use is a land use or development which would not be appropriate generally or without restriction throughout the zone district, but which, if controlled as to number, area, size, location or relation to neighborhood, and as to compatibility with official Township plans, would not be injurious to the public health, safety, convenience, morals, order, comfort, appearance, prosperity, or general welfare .This requires official public notification, a public hearing and Planning Commission action that includes any required conditions. (Land Use and Zoning Ordinances are available in Duluth Town Hall).  A building permit is also needed if the conditional use permit is approved.
